What are the Environmental Information Regulations 2004? (EIR)

 The Environmental Information Regulations 2004 provide public access to environmental information.

 The state of the environment
  • Factors affecting or likely to affect the environment
  • Measures and activities affecting or likely to affect the environment
  • Reports on the implementation of environmental legislation
  • Cost benefit and other economic analyses used within the framework of the measures and activities above
  • The state of human health and safety as they may be affected by the above

To ensure we are able to best assist you with your request, please ensure that you:

  • Make your request to the contact details above
  • Identify the information you want as clearly as you can – if a request is too general, we may ask you to provide more details
  • Send your request in writing and maintain a copy for yourself
  • Include relevant contact details (such as your name and address) for us to be able to provide the information to you
  • Refer to the relevant guidance notes on making EIR requests, which can be found on the ICO’s website


Timescales for responding to EIR requests

 Under EIR requested information must be provided in writing within 20 working days from receipt of the request, although if the request is complex and voluminous, the deadline can be extended to 40 working days.

If we require clarification from you on your request, we will write to you to ask for further clarification.  Where clarification is sought, the 20 days would start upon clarification being received.


What happens if we cannot provide the requested information?

Wherever possible, we will refer you to the relevant public authority where the requested information is held, or provide advice regarding alternative sources of the requested information.

However, we may not be able to meet your request for environmental information for a number of reasons. This may include, but is not limited to, the following:

  • The information is not held
  • The request is not subject to the provisions of the EIR
  • The public interest case to not disclose the information outweighs the public interest case to disclose the information
  • The request is manifestly unreasonable

If we cannot provide the information requested a written explanation will be provided.


Charging Policy

In some cases, there may be a reasonable charge for providing environmental information, however, no charge will be made for the provision of information and publications already made available by National Grid; advising on the availability of information; for inspecting public registers; or examining information on National Grid’s premises.

When we receive your request, we will advise whether a fee will apply and the expected cost.  Should you then wish to proceed with the request the information will be provided following receipt of the payment.

A fee may be charged for the following:

1. Staff time involved in complying with the request e.g. locating, retrieving and extracting information and putting into the required format at a rate of £25 per hour.

2. Other costs incurred in terms of printing, scanning and photocopying information:

• Printing and photocopying – 10 pence per sheet (A4 black & white); 50 pence per sheet (A4 colour); 50 pence per sheet (A3 black & white) and £1.00 per sheet (A3 colour).

 If you have made a request for environmental information and you don’t think we dealt with your request satisfactorily, you have the right to make a complaint.  Please state the reasons for your complaint in writing to:

Should you wish to speak to someone regarding your complaint, the EIR Complaints Officer can be contacted on 0800 328 7212. 

 Your complaint will then be investigated and a response issued back to you within 40 working days of receipt of the complaint.
